3. Description of Service

sVend is a prepaid water vending platform that enables:

• Tenants to purchase water vouchers for smart meters installed at their properties
• Landlords to manage properties, smart water meters, and pricing
• Automated voucher and token generation for water dispensing
• Purchase of smart meter hardware through our shop

4. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

5. Water Purchases and Payments

When purchasing water through our platform:

• All prices are displayed in South African Rand (ZAR)
• Payments are processed through secure third-party payment providers
• Water vouchers are generated upon successful payment confirmation
• Voucher codes and PINs are delivered via the platform and SMS
• Water pricing is set by individual landlords and may vary by property

6. Landlord Responsibilities

Landlords using the platform agree to:

• Ensure proper installation and maintenance of smart water meters
• Set fair and transparent pricing for water
• Maintain adequate water supply for their properties
• Respond to tenant queries and issues in a timely manner
• Comply with all applicable local regulations regarding water supply

7. Tenant Responsibilities

Tenants using the platform agree to:

• Use water responsibly and not tamper with smart meters
• Keep voucher codes and PINs secure
• Report any meter malfunctions promptly
• Not share account credentials with others

8. Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Tamper with smart meters or attempt to bypass metering
• Impersonate any person or entity
• Engage in any activity that could harm other users

9. Intellectual Property

The Service and its original content, features, and functionality are owned by sVend and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

10. Limitation of Liability

To the maximum extent permitted by law, sVend shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for water supply issues, meter hardware failures, or third-party service disruptions.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising from these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of South Africa.
